Rules on prohibited AI practices and AI literacy have applied since 2 February 2025, and obligations for general-purpose AI models have applied since 2 August 2025. Some obligations for high-risk AI embedded in regulated products apply later, on 2 August 2027.

What the August 2026 Deadline Actually Means

  • Providers — entities that build or commission an AI system and place it on the EU market under their own name

The Act’s obligations scale with risk. Before anything else — before documentation, before logging infrastructure, before product redesign — you need to classify your AI systems.

Article 12 requires that high-risk AI systems technically allow for automatic recording of events over the system’s lifetime. “Automatic” means the system generates logs on its own — manual documentation does not satisfy this requirement. “Lifetime” means from deployment to decommissioning, not just the current release.

Logs need to cover: situations where the system may present a risk or undergo substantial modification, data for post-market monitoring, and data for deployer operational monitoring. Article 18 requires logs to be retained for a minimum of six months.

Article 18 requires this documentation to be retained for 10 years.

  • Whether every AI-driven decision that could affect a user has a corresponding escalation or review pathway
  • Whether fallback paths work when the AI component is unavailable
  • Whether the fallback is documented as part of the system’s operational requirements

Consent and Data Practices

For teams deploying AI that processes personal data, GDPR and the AI Act obligations overlap significantly. Automated decision-making, training data lawful basis, and data subject rights apply simultaneously.

This is the substantive difference between experimenting with AI et deploying AI. Experimentation is low-stakes by design. Production deployment in regulated markets means every component of the system has an owner, a purpose, a boundary, and an audit trail.

Do we have a post-market monitoring plan? What triggers a review or an incident report?

Common Mistakes Companies Make

Treating compliance as a final-stage legal review. The requirements the Act imposes — logging, documentation, human oversight, transparency — are design decisions. They cannot be retrofitted into a shipped product without significant rework.

Ignoring third-party model obligations. Integrating an LLM via API doesn’t transfer your compliance responsibilities to the model provider. If you’re building a product on top of a GPAI model and deploying it in a high-risk context, the high-risk provider obligations sit with you.

Conflating AI literacy with AI governance. Knowing what the Act says is not the same as having the infrastructure to demonstrate compliance. Documentation, logging, oversight mechanisms, and conformity assessments are operational deliverables, not policy positions.
